Article 1: These interim administrative methods
are formulated for the purpose of strengthening the exchanges on the
activities of amateur radio stations and the administration of amateur
radio stations involving foreign countries or nationals in accordance
with the Radio Regulations of the People’s Republic of China.
Article 2: Foreigners, who have lived or worked
in China for more than one year and the governments of the countries
of their nationality have entered into agreements on amateur radio
stations with the Chinese governments, and foreign organizations
can apply for installation of personal or collective amateur radio
stations within the territory of China.
Article 3: The conditions and procedures for
installation of amateur radio stations are as follows:
1. Operators of personal or collective
radio stations must have the operation certificate of amateur radio
stations issued by the counties of their nationality; those that
have not acquired the operation certificate of the countries of
their nationality must be qualified through the examinations organized
by the State relevant authority and acquire the Operation Certificate
of Personal Amateur Radio Stations for Foreigners or the Operation
Certificate of Collective Amateur Radio Stations for Foreign Organizations;
2. Individuals or organizations shall submit
written applications to China Radio Sport Association together
with the documentation of their identity in China provided by the
receiving departments of China (at above prefecture or municipal
level) or by the embassies to China of the countries of their nationality,
as well as operation certificate of personal amateur radio stations
and photocopies their passport;
3. Upon completion of examination and verification
of the above materials, China Radio Sport Association shall pre-assign
call signs;
4. The radio regulatory agencies of the provinces,
autonomous regions and directly-administered municipalities, in
which radio stations are located, shall examine and verify the
qualified applicants, approve their applications for installation,
issue licenses of radio stations and file the case with the State
radio regulatory authority for the record;
5. Applicants shall be able to install radio
stations on the strength of the license issued by the radio regulatory
agencies of relevant provinces, autonomous regions and directly-administered
municipalities.
Article 4: Foreigners coming to China on a temporary
basis (less than but not including one year) who wish to operate
amateur radio stations shall apply to China Radio Sport Association
for Operation Certificate for Visitors.
The procedures for applying for Operation Certificate for Visitors
are as follows:
1. Applications shall be submitted to China Radio
Sport Association, accompanied by personal passport and operation
certificate of amateur radio stations of the countries of his/her
nationality (photocopy);
2. Upon verification, China Radio Sport Association
shall issue Operation Certificate for Visitors;
3. Certificate holders can start operation at
collective amateur radio stations of China or at personal amateur
radio stations designated by China Radio Sport Associations. The
right of operation shall not exceed the as stipulated in the Operation
Certificate for Visitors and the license of radio stations;
4. The call signs to be used can be personal
call signs or the call signs of the radio stations.
Article 5: Foreign travelers to China of the
countries that have entered into agreements on amateur radio stations
with China, who need to use equipment at VHF/UHF frequency band
temporarily to conduct amateur radio communications, shall make
oral applications to China Radio Sport Association, and can engage
in communication operation upon approval. Their call signs can
be their personal call signs or B + area code of China.
Article 6: Foreigners who install and operate
amateur radio stations shall abide by the laws and regulations
of China and shall not carry out any activity that may jeopardize
the State sovereignty and security and damage the reputation and
interests of China. The right and place of operation shall not
exceed the range as designated.
Article 7: Foreigners who bring amateur radio
equipment into China shall undertake examination and approval procedures
with the radio regulatory agencies of the provinces, autonomous
regions and directly administered municipalities in accordance
with the relevant regulations.
Article 8: People coming from Hong Kong, Macao
and Taiwan who wish to install and operate amateur radio stations
in the mainland China shall also observe these interim methods.
Article 9: Foreign students and the students
of Hong Kong, Macao and Taiwan studying in the mainland China who
wish to participate in the activities of collective radio stations
of the schools in which they study shall be treated on an equal
basis as other students of the schools.
Article 10: Amateur radio stations shall accept
supervision and inspection by the radio regulatory agencies, sport
administrative departments and radio sport associations at all
levels.
Article 11: Should these interim methods and
other radio regulations be violated, China Radio Sport Association
shall impose penalties by means of terminating operation or revoking
Operation Certificate. The radio regulatory agencies of the provinces,
autonomous regions and directly-administered municipalities can
revoke radio station license, close down radio stations and confiscate
equipment.
Article 12: State radio regulation authority
and State Sport General Administration shall be responsible for
interpretation of these interim methods.
Article 13: These interim methods shall become
effective on the date of promulgation.
